We are very concerned with the suppression of freedom of speech by Yahoo Taiwan and police under Ma Ying-Jeou’s administration.
On 21/11/2008, the popular, personal and pro-democratic Mango Daily Blog was shut down by Yahoo Taiwan without notification. When asked to explain the reasoning behind their actions, the Yahoo officials used “violation of copyright act” as the reason to shut down Mango Daily.
We found out the man who reported Mango Daily, is a current policeman who was part of the team that was responsible for Chinese envoy Chen Yun-Lin’s safety between 3/11/2008 -7/11/2008. He criticized some of Mango Daily’s entries. In return, Mango Daily responded to his criticism, and referred to the policeman’s blog. After the policeman reported to Yahoo Taiwan three times, Mango Daily was shut down without notification.
However Mango Daily’s entries were classified “fair use” according to the Copyright Act of Republic of China (Taiwan).
If Mango Daily violated the Copyright Act, then Yahoo Engine will have violated this Act when various bloggers’ materials came up in Yahoo’s search result page.
When newspaper columnists, film critics and sport journalists refer to quotes and creation of others, and makes reviews that do not satisfy their authors, does that mean all these companies should be shut down because of “violation of copyright?”
These writers do not get sued because their actions were classified as “fair use” of other people’s work.
Yahoo Taiwan have violated Mango Daily’s right to freedom of speech by using “violation of copyright” as an excuse. We think it is perfectly legitimate to make this claim as Yahoo has previous record of leaking personal, confidential information to the Chinese government which resulted in a 10-year sentencing of a Chinese journalist in 200.
We are deeply concerned when we read some of the policeman’s blog entries.
The following are just some examples:
“Jump away from our personal political opinions, we have a common enemy…it is not over the top for police officers to treat armless and honest Taiwanese like enemies.”
“Take away my duty as a police, I’ve been patient with you for a long time, it’s only just right to beat you up, there is nothing wrong with that.”
“The safety of the colleagues are more important than anything, the guns must be pointed towards the outside.”
“At lease being a gon-an (公安, public security, a term used to describe security in People’s Republic of China), we won’t be bullied by the citizens.”
“I don’t know how much more tax I have paid compared to them (citizens).”
“Under our commander’s order, we rushed out…the seniors picked up the police stick and swung it like crazy”
“The accumulation of these annoyance for a long period of time, everyone wanted to rest early, and it’s no wonder when the evacuation command was ordered, the police would carry out the task with such decisiveness”
We are concerned with the kind of attitude the police academic systems are producing. We are very concerned that the protectors of civilians think that there is nothing wrong with beating up armless Taiwanese who pay less tax than them. We are worried that these armed policemen treat citizens like enemies. This policeman has shut down his own blog. He has set up a new one but will shut it down in 72 hours.
We are extremely concerned because this is not the only incidence that has stunned the country. On 25/10/2008, a massive anti-china rally was held in Taipei. Before it started a policewoman appeared at the site and claimed her chief in command were from “People’s Republic of China.”
On 4/11/2008, protesters against Chinese envoy Chen Yun-Lin were dancing outside a CD store, which was playing the album “Song of Taiwan” at the time. The police commander rushed into the store along with another half a dozen, demanded the store employee to turn off the stereo and shut down the store. Since then this police commander has claimed that the sound of the stereo was too loud, the protesters were attacking the store, there were smear attacks against him, he did not do anything wrong and in fact, he would do the same again next time.
Internet users in Taiwan are also worried that Ma’s administration are learning internet control from the Communist. They are currently working with a major telecommunication company to promote internet filters. Users found that these filters bans porn, violence, and a pro-independence website, funded by Professor Peng Ming-min, the first ever presidential candidate from the opposition party Democratic Progressive Party.
Taiwan’s democracy is disappearing like an hourglass. Please help us by keeping an eye on the Ma adiminstration and intervene with your specialities. We need your assistance to overcome this trend and move Taiwan’s hard-fought democracy forward, not backward.

Article 49
When reporting current events by means of broadcasting, photography, film, newspaper, network, or otherwise, works that are seen or heard in the course of the report may be exploited within the scope necessary to the report.
Article 52
Within a reasonable scope, works that have been publicly released may be quoted where necessary for reports, comment, teaching, research, or other legitimate purposes.
Article 65
Fair use of a work shall not constitute infringement on economic rights in the work.
In determining whether the exploitation of a work complies with the provisions of Articles 44 through 63, or other conditions of fair use, all circumstances shall be taken into account, and in particular the following facts shall be noted as the basis for determination:
1. The purposes and nature of the exploitation, including whether such exploitation is of a commercial nature or is for nonprofit educational purposes.
2. The nature of the work.
3. The amount and substantiality of the portion exploited in relation to the work as a whole.
4. Effect of the exploitation on the work's current and potential market value.
Where the copyright owner organization and the exploiter organization have formed an agreement on the scope of the fair use of a work, it may be taken as reference in the determination referred to in the preceding paragraph.
In the course of forming an agreement referred to in the preceding paragraph, advice may be sought from the specialized agency in charge of copyright matters.
